Transitional law for British nationals in the Netherlands
On 29 March 2019 the United Kingdom (UK) will leave the European Union (EU). This exit (Brexit) has consequences for most British nationals and their family members who want to continue living in the Netherlands.
After the Brexit, the British nationals will no longer be EU citizens. The exact consequences are not clear yet, because this depends on the vote of the British government on the Brexit proposal on 15 January 2019. It is possible that there will be no agreement (no deal). Both a deal and a no deal affect the right of residence of British nationals in the Netherlands. However, the Brexit does not affect the right of residence if British nationals have the Dutch nationality on 29 March 2019.
Anticipating a possible no deal, the Dutch government is introducing a 15 months transition period for British nationals and their family members. British nationals – living in the Netherlands before the Brexit on 29 March – can live, work and/or study for another 15 months. This transitional law also applies for family members of British nationals who do not have an EU nationality.
Before 29 March 2019, the IND will send the temporary residence permit (for the 15 months transition period) in the form of a letter to British nationals and their family members who are currently living in the Netherlands and registered in the Personal Records Database (Basisregistratie Personen, BRP). We advise all British nationals living in the Netherlands to check if you are registered in the Netherlands correctly. The letters are already available online through the following website of the IND: https://ind.nl/en/pages/brexit.aspx.
In the event of a no deal, the Dutch immigration office (IND) will contact all British nationals during the transitional period of 15 months and invite them to apply for a permanent Dutch residence permit. This residence permit is necessary after the transitional period and will be granted if British nationals will meet the current conditions that apply for EU nationals.
