New rules effective from 13 July

The Ministry of Law and Human Rights have created a circular letter No. IMI-GR.01.01-1102 of 2020 on immigration services on the new normal period. The new rules will be in effect starting 13 July 2020.

Who will be affected?

– Current Stay Permit Holders abroad
– Emergency Stay Permit Holders in Indonesia

Expired ITAP & ITAS Holders Return to Indonesia
– Foreigners holding expired Permanent Stay Permit (ITAP) & Temporary Stay Permit (ITAS) abroad who already obtained approval letter from the Ministry or Technical Institution and in terms of family reunion will need to return to Indonesia to extend their stay permit to the local immigration office within 60 calendar days of the signing of the circular letter.
– Foreigners not abiding by the timeline restriction above will be required to apply for a new Visa prior re-entering Indonesia.

Extension of Visitor Stay Permit (ITK), Valid ITAS & ITAP Holders
– Foreigners holding ITK, ITAS & ITAP that are still valid and currently in Indonesia are now able to renew their stay permits to the local immigration office accordingly.

Returning Status of Emergency Stay Permit (ITKT)
For Visitor Stay Permit Holders
– ITK holders who have been granted Emergency Stay Permit (ITKT) may request for a stay permit extension until the Covid-19 pandemic in Indonesia is declared over if there is no available means of transportation to exit from Indonesia.
– Foreigners who have obtained ITKT extension may apply for change status from ITKT to ITAS according to the current regulation.
– Extension request must be done within 30 calendar days upon the release of this circular letter.
– Foreigners not abiding by the aforementioned points will be imposed with penalties.

For ITAS & ITAP Holders
– Expired ITAS/ITAP holders who have been granted Emergency Stay Permit (ITKT) will need to renew their ITAS at the local immigration office.
– If ITAS can no longer be extended, they must leave within 30 calendar days of the release of the circular letter.
– Foreigners not abiding by the aforementioned points will be imposed with penalties.

Visa on Arrival Holders
– Visa on Arrival holders who have been granted Emergency Stay Permit (ITKT) may request for a visa extension until the Covid-19 pandemic in Indonesia is declared over if there is no available means of transportation to exit from Indonesia.
– Visa on Arrival extension request must be completed within 30 days upon the release of this circular letter.
– Foreigners not following the aforementioned points will be imposed with penalties.

Free Visit Visa Holders
– Free Visit Visa holders who have been granted Emergency Stay Permit (ITKT) are required to leave Indonesia within 30 days upon the release of this circular letter.
– Foreigners not abiding by the abovementioned points will be imposed with penalties.

Santa Fe Analysis

For expired ITAS or ITAP holders abroad, Santa Fe advises to return to Indonesia within the specified timeframe to avoid permit cancellations and re-applying stay permits prior to returning to Indonesia in the future.
Emergency Stay Permit holders initially holding ITAS/ITAP, we urge you to immediately renew expired ITAS/ITAP.
For Emergency Stay Permit holders initially granted Visitor Stay Visa and Visa on Arrival, if there are no available means of transportation to return to the home country, we urge you to immediately request for an extension at your local immigration office. If there are available means of transportation to return to your home country, we urge you to search for transportation means to exit Indonesia to avoid imposition of overstay penalties.
For Emergency Stay Permit holders initially granted Visitor Stay Visa we urge you to immediately search for transportation to exit Indonesia to avoid imposition of overstay penalties.
