Immigration update: Malaysia | New requirement for FKW positions

Mandatory Foreign Knowledge Worker (FKW) Positions to be advertised on JobsMalaysia

With reference to the Governments initiative made by the Cabinet on 4th June, 2020 regarding employment of Foreign Knowledge Workers, companies are required to advertise job vacancies on the JobsMalaysia portal for a minimum of 30 days.

Who are affected?

All companies who utilise the services of MDEC and ESD for foreign knowledge workers pass applications.

Background

The government of Malaysia is prioritising available jobs to local Malaysian nationals prior to opening the same positions to foreign workers, due to the high unemployment rate caused by the effects of the current pandemic and its impact on business.

Impact

• Companies are required to advertise job vacancies on the JobsMalaysia portal – https://www.jobsmalaysia.gov.my/jobsmy for a minimum of 30 days, prior to JobsMalaysia issuing a “Surat Perakuan” to the company, confirming that the position was advertised locally and a suitable candidate was not located.
• MDEC / ESD is still finalising the details of how this could impact future applications and all on going cases will be processed as usual.
