Vacancies advertisement via MYFutureJobs portal for new Expat hires

Effective from 1st January 2021, companies who are hiring expatriates are required to advertise the job vacancies on MYFutureJobs portal for a minimum of 30 days, before proceeding to file an application via the approving agency.

Who are affected

All Companies who are planning to bring in foreign nationals to take up a new position in Malaysia.

Background

The MYFutureJobs portal was introduced by the government to ensure local employment is given priority for vacant job positions in Malaysia, owing to the economic slow down and the high unemployment rate due to the pandemic. The new rule was to be implemented in November 1st 2020, but was postponed to January 1st 2021.

Impact

+ Mandatory advertisement requirement on the job’s portal:
i) New applications of Employment Pass

+ Application types exempted from advertising on the portal:
i) Dependant Pass (DP), Social Visit Pass (SVP) – Internship (SVP – I), Visit Pass (VP), Professional Visit Pass (PVP) and Resident Pass-Talent (RPT)
ii) Expatriates with salary RM15,000 above
iii) Expatriates who are in key positions in the organisation (Managing Directors, CEOs)
iv) Investors / Owners / Shareholders of the organisation

+ For niche skills that is unavailable locally in Malaysia and requires foreign expertise, a form needs to be filled up at the link given http://bit.ly/PDKKPERKESO. The form will be accessed by SOCSO (Social Security Organisation) and an exemption of the job’s portal advertisement will be granted if deemed fit.

Implementation

Effective from 1st January 2021.
