Updates on Brexit requirements for UK nationals residing in Italy

The Italian government provided updates regarding the Brexit vademecum issued on 16 December.

Who will be affected?

UK citizens resident in Italy by 31st December 2020 and family members accompanying or joining them, even after that date.

New regulations according to Brexit were issued.

Impact

UK citizens resident in Italy by 31st December 2020 and family members accompanying or joining them must consider the new regulations.

Implementation

The Italian Government made some changes to the Brexit vademecum that can be summarised as follows (other points stated in our previous alert remain valid).

UK nationals, besides other documents, to be entitled to apply for the electronic document must have a certificate of personal registration (attestazione di iscrizione anagrafica), issued by the Town Hall of residency, proving the registration by 31st December 2020 or, alternatively, self-certification of being registered with the ‘anagrafe’ by 31st December 2020 and that registration has not been subsequently cancelled, pursuant to art. 46-47 D.p.r. 445/2000.

Family members of UK nationals must provide besides the other documents, a copy of the residence document in electronic format issued by the Police or, alternatively, a copy of the certificate of registration of the UK citizen proving the registration by 31st December 2020. Family members also need to prove the family bond with the UK citizen, by means of a certificate stating the family status of the UK citizen, issued by the relevant authority in the country of origin.

From 01 January 2021, British students who meet the requirements of Directive 2004/38 /EC and are registered to the resident population register (anagrafe) or to the temporary population register by 31st December 2020 can apply at the local Police Department in the city of residency, for the new electronic document.

The certificate stating that the UK citizen is registered at the ‘anagrafe’ office at the town hall by 31st December 2020 or the related self-certification are mandatory documents to obtain the electronic residence document by the Police Department in the city of residency. However, UK citizens who are not yet registered in the registry by 31st December 2020, but who can prove with suitable documentation their legal stay on the Italian soil on or before 31st December 2020 (e.g. employment contract, certificate of enrolment in a course of study) are entitled to apply for the electronic residence document at the local Police Department in the city of residency.

In case the UK citizen changes residence before having obtained the electronic document, the Uk national must apply for the electronic document to the police department in the place where he/she is resident at the moment of the application.

UK citizens who submit the application for registration by 31st December 2020 won’t have problems since the registration starts from the submission date to the local town hall, even if the process will be finalised in 2021 (with a positive outcome).

UK citizens/resident who need to travel, live and work in Italy, must consider the new conditions.
