New procedure for UK nationals and dependants residing in Spain after July 6 2020
The new law stipulates the considerations to be taken into account and the procedure to be further differentiating if the British person resided in Spain before or after July 6.
Situation 1: UK National owner of EU Certificate before 6 July.
+ The issuance of the new TIE (Identity Card for foreign) will be requested to the police in person and by appointment.
+ Depending on the years you have lived in Spain, Residence card will be issued for 5 years (Temporary) or for 10 years (Permanent)
Situation 2: Non Community family member of UK person who has EU Certificate before 6 July.
+ The issuance of the new TIE (Identity Card for foreign) will be requested to the police in person and by appointment.
+ Depending on the years you have lived in Spain, Residence card will be issued for 5 years (Temporary) or for 10 years (Permanent)
Situation 3: UK National and family members without EU Certificate due to arrival after 6 July and before 31 December.
+ Same Rights and freedoms as their compatriots residing in Spain prior to that date.
+ They will request (personally or through representative) the residence document in Immigration Office of residence.
+ The application safeguard will prove the status of legal stay in Spain until resolution of the same
+ The Administration must respond within a maximum period of 3 months from the request.
+ Within one month of the grant, you must apply to the Police dependences for the new TIE in person and by appointment.
+ Residence Document will be validity of 5 years
Situation 4: UK National and family members without EU Certificate that will arrive Spain after December 31.
+ Pending of agreement between UK and EU or, in the absence, of Spanish legislation governing rights and freedom of UK Citizen in Spain from that moment
